SLF LABOR AND EMPLOYMENT ALERT   April 2007

Changes to EEO-1 Reporting Requirements

Beginning with the September 30, 2007 reporting period, employers must use a revised EEO-1 report promulgated by the U.S. Equal Employment Opportunity Commission (“EEOC”).  The changes to the EEO-1 report affect the job, ethnic and race categories.  The EEOC has published a questions and answers article for commonly asked questions on the changes, which may be found at http://www.eeoc.gov/eeo1/qanda.html.

Changes to the EEO-1 Job Categories

The category regarding Officials and Managers has changed.  First, business and financial occupations are no longer in the Officials and Managers category; instead, they will be located in the Professionals category.  According to the EEOC, this change was made “to improve data for analyzing trends in mobility of minorities and women within Officials and Managers.”  Second, the category has been split into two different levels depending on responsibility and influence within the organization.  The two levels will be split as follows:

    1. Executive/Senior Level Officials and Managers (plan, direct and formulate policy, set strategy and provide overall direction; in larger organizations, within two reporting levels of CEO)
    2. First/Mid-Level Officials and Managers (direct implementation or operations within specific parameters set by Executive/Senior Level Officials and Managers; oversee day-to-day operations)

Changes to the EEO-1 Ethnic and Race Categories

The changes to the Ethnic and Race categories of the EEO-1 report are as follows:

    1. adds a new category titled "Two or more races"
    2. divides "Asian or Pacific Islander" into two separate categories: "Asian" and "Native Hawaiian or other Pacific Islander"
    3. renames "Black" as "Black or African American"
    4. renames "Hispanic" as "Hispanic or Latino"
    5. strongly endorses self-identification of race and ethnic categories, as opposed to visual identification by employers

The EEOC has published a questions and answers article for commonly asked questions on the implementation of the revised race and ethnic categories, which may be found at http://www.eeoc.gov/eeo1/qanda-implementation.html.
