U.S. Department of Labor Publishes Final Regulations Implementing FMLA
On November 17, 2008, the U.S. Department of Labor published its final regulations regarding the Family and Medical Leave Act of 1993. The new regulations go into effect 60 days from publication (January 16, 2009). To view the new regulations go to: http://www.dol.gov/federalregister/ HtmlDisplay.aspx? The final regulations address various aspects of the FMLA, including new military family leave entitlements included in amendments to the FMLA enacted as part of the National Defense Authorization Act. The NDAA provides additional job-protected leave rights to eligible employees of covered employers who provide care for covered service members with a serious injury or illness and because of qualifying exigencies arising out of the fact that a covered military member is on active duty or has been notified of an impending call or order to active duty in support of a contingency operation. According to the DOL, the new regulations will “help workers and their employers better understand their rights and responsibilities, and speed the implementation of a new law that expands FMLA coverage for military family members.”
