ADVANCE COPY OF GINA INTERIM RULES MADE AVAILABLE

As reported in previous editions of the Labor and Employment Alert, various provisions of the Genetic Information Nondiscrimination Act (GINA) will begin to take effect on November 21, 2009. Interim rules have now been promulgated by the IRS, DOL and HHS relating to discrimination in health insurance coverage and group health plans, as well as a rule that implements changes to the HIPAA Privacy Rule so that it conforms to the requirements of GINA. While the interim rules will not be published until October 7, 2009, advance copies may be obtained at: http://www.federalregister.gov/OFRUpload/OFRData/2009-22504_PI.pdf (non-discrimination rules) and http://www.federalregister.gov/OFRUpload/OFRData/2009-22492_PI.pdf (HIPAA Rule). Employers with health insurance plans should make themselves familiar with these new rules as the effective date of GINA draws near.

NEW FEDERAL REGULATION PROHIBITS FEDERAL EMPLOYEES FROM TEXTING WHILE DRIVING
