A jury returned a verdict in favor of the defense in a federal case tried by Lisa B. Fountain and Robert J. Sniffen earlier this month in the U.S. District Court for the Northern District of Florida. In the case of Maria Jimenez v. The Florida Commission on Human Relations, Ms. Jimenez brought a Title VII claim alleging she was discriminated against on the basis of her national origin. The defense presented evidence to the jury that Ms. Jimenez was assigned Spanish speaking related tasks not because of Ms. Jimenez's national origin, but rather because of her ability to speak Spanish. The jury agreed with the defense, and found that the Commission did not discriminate against Ms. Jimenez on the basis of her national origin. Judgment was thereafter entered in favor of the defense.
